Altering the powers of the Center for Firearm Violence Prevention and Intervention to include the creation of certain resources, tools, and educational materials related to firearms; and authorizing the Center to consult with State and local agencies and third-party organizations in carrying out those powers.

Establishing the Maternal Health Monitoring Pilot Program in the Maryland Department of Health to support pregnant and postpartum Maryland Medical Assistance Program recipients who have higher risks of pregnancy complications because of maternal hypertension or maternal diabetes; requiring the Department to select at least one managed care organization to administer the Program; requiring the managed care organizations to contract with a technology vendor to offer remote patient monitoring services to participants; etc.

Establishing the Social Isolation and Loneliness Pilot Grant Program in the Maryland Department of Health to provide grants for the operating costs associated with the maintenance or expansion of programs that target vulnerable populations with socioemotional support addressing social isolation and loneliness; requiring the Governor to include in the budget bill for fiscal year 2028 an appropriation of $100,000 for the Program; etc.

Requiring restaurants to make available to each customer a written disclosure of each main food allergen, if any, that is an ingredient in each menu item; and excluding a violation of the Act from certain criminal penalties.

Prohibiting a person from offering for sale in the State a gene structure- or function-modifying product unless the product is labeled in a prominent and conspicuous manner with the words "gene structure- or function-modifying product" and all potential risks, side effects, adverse effects, and other reasonably possible effects that the product may have; and establishing penalties for a violation of the Act.

Requiring a hospital to conduct screening on a patient presenting at an emergency department of the hospital to determine whether the patient has an emergency pregnancy-related medical condition; establishing requirements and prohibitions related to the treatment and transfer of a patient who has an emergency pregnancy-related medical condition; requiring a hospital to allow the termination of a pregnancy in certain circumstances; etc.

Altering certain terminology used in the Sheila E. Hixson Behavioral Health Services Matching Grant Program for Service Members and Veterans that refers to active service members to refer to service members.

Establishing minimum detectable disinfectant residual level requirements, disinfectant residual testing requirements, and related requirements for the control of Legionella bacteria and other pathogens in the public water supply; requiring suppliers of water to provide certain notices and records regarding disruptions in the water distribution system; establishing requirements for the investigation of reported cases of Legionnaires' disease; etc.

Requiring that an abortion be performed by a physician, rather than a qualified provider; repealing certain provisions of law related to State interference with an abortion, regulations related to abortion, and liability or criminal punishment for qualified providers who perform an abortion; prohibiting a physician from knowingly performing, inducing, or attempting to perform or induce an abortion under certain circumstances and subject to certain exceptions; etc.

Establishing the Henrietta Lacks Commission to take certain actions related to the legacy of Henrietta Lacks and the use of HeLa cells; and requiring the Commission, beginning in 2027, to report by December 1 annually to the Governor and the General Assembly on its activities regarding oversight of life sciences activities in the State and promotion of education on the life of Henrietta Lacks.

Altering the Public Access Automated External Defibrillator Program, including by establishing requirements regarding an automated external defibrillator (AED) coordinator, repealing certain provisions of law regarding regional council AED committees, and exempting certain law enforcement agencies from being required to obtain a certificate for an AED deployed in a patrol vehicle of the law enforcement agency; etc.

Altering the definition of "medical record" for purposes of law governing the confidentiality of medical records to require that certain information be recorded by a health care provider through certain means, instead of entered into the record of a patient or recipient, and to include certain electronic messages.

Prohibiting a health care provider from using the health care provider's human reproductive material when providing assisted reproductive treatment without the consent of the recipient of the treatment; prohibiting a health care provider from using a donor's human reproductive material to provide assisted reproductive treatment without the donor's informed consent or in a manner that is inconsistent with the donor's consent; etc.

Imposing an excise tax on certain gross receipts of certain firearms dealers derived from the sales of firearms, firearm accessories, and ammunition in the State and sales of firearms to State residents; and requiring the Comptroller to distribute a certain portion of the tax revenues to the Maryland Violence Intervention Program, the Center for Firearm Violence Prevention, the Coordinated Community Supports Partnership, the Survivors of Homicide Victims Program, the Trauma Physician Services Fund, and the R Adams Cowley Shock Trauma Center.

Requiring certain providers and laboratories to provide certain written information to patients receiving prostate-specific antigen testing; and requiring clinical laboratories that administer prostate-specific antigen tests to follow certain disclosure requirements, use standard calibration for testing assays and report test results in a standard manner, make certain disclosures to ordering providers, and follow guidelines from certain organizations.

Requiring the Maryland Department of Health to adopt regulations requiring the Maryland Medical Assistance Program to reimburse a psychiatric rehabilitation program for a minimum of 6 and a maximum of 30 psychiatric rehabilitation community psychiatric support services delivered to certain individuals each month.

Imposing an excise tax on certain gross receipts of certain firearms dealers derived from the sales of firearms, firearm accessories, and ammunition in the State and sales of firearms to residents of the State; requiring the Comptroller to distribute a portion of the tax revenues to the Maryland Violence Intervention Program, the Center for Firearm Violence Prevention, the Coordinated Community Supports Partnership, the Survivors of Homicide Victims Program, the Trauma Physician Services Fund, and the Cowley Shock Trauma Center; etc.

Requiring the Maryland Department of Health to establish certain specialized clinics for the management and treatment of sickle cell disease and establish a scholarship program for medical residents who specialize in classical hematology with a focus on sickle cell disease; and requiring the Governor for fiscal year 2028 to include in the annual budget bill an appropriation of $6,138,000 to support clinic operations, staffing, training, and social support services.

Revising, restating, and recodifying the laws of this State relating to the Maryland Medical Assistance Program.

Altering the type of toilet that certain food establishments may use to comply with the requirement to provide a convenient lavatory; requiring that the fee for an on-farm food service facility license be determined by the Maryland Department of Health based on certain factors and prohibiting the fee from exceeding $100; establishing a 1-year term for an on-farm service facility license; and requiring the Department, in consultation with other departments and stakeholders, to adopt regulations governing on-farm service facility licenses.

Requiring the Maryland Technology Development Corporation to establish a grant and loan program to provide grants and loans for Long COVID innovation; requiring the Corporation to contract with an independent review committee composed of scientific experts in the field of Long COVID; establishing the Maryland Long COVID Research Fund under the administration of the Corporation as a special, nonlapsing fund; and requiring that the interest earnings of the Fund be credited to the Fund.

Requiring the Executive Director of the Maryland Institute for Emergency Medical Services Systems to coordinate the minimum equipment, supplies, and medications to be available on emergency medical services vehicles; requiring each county and municipality that operates or contracts emergency medical services to conduct quarterly reviews of ambulance performance data; and requiring each county to establish and maintain a formal complaint filing system regarding ambulance quality, conduct, or compliance.

Establishing the Maryland Commission on Women's Health Advancement to study the feasibility of establishing a State women's hospital in Southern Maryland and a statewide clinical network to advance women's health; requiring the Commission by January 1, 2027, to submit to the Governor and the General Assembly an initial action plan, including a timeline, milestones, and specific research objectives; etc.

Establishing minimum detectable disinfectant residual level requirements, disinfectant residual testing requirements, and related requirements for the control of Legionella bacteria and other pathogens in the public water supply; requiring the Department of the Environment and the Department of Health, by October 1, 2027, to report to the Governor and General Assembly with recommendations for legislative action to control legionella bacteria and other waterborne pathogens in the public water supply of the State; etc.

Establishing the Maryland Commission for Boys' and Men's Health in the Maryland Department of Health; providing the purpose of the Commission is to raise public awareness of health issues specific to boys and men, including prostate and testicular cancer, oral cancer, cardiovascular disease, depression, diabetes, and substance use disorders; and requiring the Commission to submit a report every 2 years beginning in 2028, to the Governor and certain committees of the General Assembly, with recommendations for certain policy changes.

Requiring the Maryland Medical Assistance Program and certain insurers, nonprofit health service plans, and health maintenance organizations to provide certain coverage related to orthoses beginning January 1, 2027; clarifying that certain mandated benefits related to prostheses include all prostheses determined by a treating health care provider to be medically necessary for completing daily living activities, essential job-related activities, or performing certain other physical activities; etc.

Requiring each county board of education to ensure that each public school regularly restock dispensers in the women's restrooms at the school with menstrual hygiene products.

Prohibiting a retailer from distributing, selling, or exposing for sale a medetomidine product or xylazine product unless the purchaser provides proof the intended use is for institutional, veterinary, or scientific purposes; prohibiting a retailer from distributing, selling, or exposing for sale a medetomidine or xylazine product to an individual under the age of 21 years; requiring a retailer that prepares, distributes, sells, or exposes for sale a medetomidine or xylazine product to maintain certain records; etc.

Establishing requirements and prohibitions regarding food and milk product labeling; and requiring the Maryland Department of Health to create a marketing program and educational materials to inform consumers about the meaning of quality dates and safety dates for food labels by July 1, 2027, and to post the information on the Department's website.

Requiring the Maryland Department of Health to establish an enhanced reimbursement structure for Maryland Medicaid Assistance Program providers that deliver medical services to individuals with intellectual and developmental disabilities; and providing the Act is contingent on the availability of federal funds through the federal Health Equity for Adults with Disabilities (HEADs UP) Act or any other federal law or funding stream supporting health care equity for individuals with intellectual or developmental disabilities.

Extending to December 31, 2027, the Task Force on Responsible Use of Natural Psychedelic Substances to study and make recommendations related to the use of natural psychedelic substances; and requiring the Task Force to submit an updated report of its findings and recommendations to the Governor and the General Assembly on or before October 31, 2026.

Adding bacterial vaginosis to the list of diagnoses for which certain health care providers may prescribe, dispense, or otherwise provide antibiotic therapy to a sexual partner of a diagnosed patient without making a personal physical assessment of the sexual partner.

Requiring the Governor to annually proclaim the month of May as Water Safety Month; and requiring the proclamation to urge certain activities designed to raise awareness about drowning prevention and to promote safe practices around all bodies of water.

Altering the duties of the Virginia I. Jones Alzheimer's Disease and Related Dementias Council to include an examination of the capacity of health care providers to deliver care to certain individuals and to identify methods by which the State can assist health care providers in delivering care to certain individuals; establishing the Dementia Services and Brain Health Program in the Maryland Department of Health to lead the State's public health efforts relating to brain health and dementia; etc.

Requiring the Maryland Medical Assistance Program and certain insurers, nonprofit health service plans, and health maintenance organizations to provide certain coverage related to orthoses beginning January 1, 2027; clarifying that certain mandated benefits related to prostheses include all prostheses determined by a treating health care provider to be medically necessary for completing daily living activities, essential job-related activities or performing certain other physical activities; etc.

Establishing the Mental Health Care Fund for Children and Youth to support improved access to mental health care services for children and youth in the State; imposing a tax on certain annual revenues derived from certain digital social media services in the State; providing for the calculation and collection of the tax; requiring the Comptroller to distribute revenue from the tax in a certain manner; etc.

Providing an addition modification under the corporate income tax for the amount of certain direct-to-consumer advertising expenses for certain covered drugs paid or incurred during the taxable year that are deducted under the Internal Revenue Code; and applying the Act to all taxable years beginning after December 31, 2025.

Altering the time period after the delivery of a newborn following a high-risk pregnancy in which a hospital or freestanding birthing center must call the birthing parent to evaluate the birthing parent's status and, as necessary, provide certain information to be at least 24 hours, but not later than 72 hours, rather than at least 24 hours, but not later than 48 hours after discharge.

Requiring the Governor to include in the annual budget bill at least 3% of the special funds collected from the Medicaid quality assessment imposed on certain nursing facilities to fund the operations of the Office of the Long-Term Care Ombudsman.

Extending to December 31, 2027, the Task Force on Responsible Use of Natural Psychedelic Substances to study and make recommendations related to the use of natural psychedelic substances; adding a representative of a historically Black college or university in the State to the Task Force; and requiring the Task Force to submit an updated report of its findings and recommendations to the Governor and the General Assembly on or before October 31, 2026.

Repealing a provision of law prohibiting an electronic health network or electronic medical record vendor from charging a fee for the release of certain patient records or transactions.

Requiring that the hospital representative on a local drug overdose fatality review team be a vice president, a chief medical officer, or an assistant medical officer at the hospital.

Increasing from $50,000 to $100,000 the maximum amount of annual revenue a business may generate from the sale of cottage food products to be considered a cottage food business.

Requiring the Director of Education and Workforce Skills Training for Correctional Institutions to consult with the State Correctional Ombudsman about the operation of education and workforce skills training programs in adult correctional institutions; establishing the Certified Peer Recovery Specialist Training Program for Incarcerated Individuals in the Maryland Department of Labor; and authorizing the Governor in fiscal year 2028 and each fiscal year thereafter to provide sufficient funding for the program in the annual budget bill.

Modifying certain reporting requirements, boards, and commissions for practicability and efficiency; repealing certain reporting requirements that are unnecessary, obsolete, or duplicative; repealing as obsolete the Renewable Fuels Incentive Board, Criminal Justice Information Advisory Board, Two-Generation Family Economic Security Commission, and Commission on Trauma-Informed Care; repealing as unnecessary the Partnership for Workforce Quality Advisory Board; etc.

Requiring research facilities that are located in the State and required to submit an Animal and Plant Health Inspection Service Form 7023 to pay contributions for the Human-Relevant Research Fund to the Department of Agriculture, rather than the Maryland Department of Health; and establishing that a research facility that fails to pay the contribution required by the Act may be subject to a civil penalty of not more than $1,000 per day.

Requiring certain hospitals licensed in the State to establish and maintain a clinical staffing committee and to implement a clinical staffing plan; requiring each clinical staffing committee to develop a clinical staffing plan; requiring, on or before July 1 each year, each hospital's clinical staffing committee to conduct a review of the clinical staffing plan for certain purposes; requiring, on or before January 1, 2028, each hospital to implement a clinical staffing plan and assign personnel in accordance with the plan; etc.

Establishing the Community Forensic Aftercare Program in the Maryland Department of Health to monitor committed persons on conditional release and individuals with mental illness or intellectual disability who are required to be monitored under certain circumstances; requiring the Program to establish a community monitoring board to make certain recommendations and decisions related to conditional release and out-of-state travel; requiring the Board to maintain a written record of its findings, recommendations, and decisions; etc.

Extending through fiscal year 2030 the requirement that an appropriation of $500,000 be included in the annual budget bill for the Recovery Residence Grant Program.

Adding bacterial vaginosis to the list of diagnoses for which certain health care practitioners may prescribe, dispense, or otherwise provide antibiotic therapy to a sexual partner of a diagnosed patient without making a personal physical assessment of the sexual partner; and adding licensed certified midwives to the list of health care practitioners who may prescribe, dispense, or otherwise provide antibiotic therapy to a sexual partner of a diagnosed patient without making a certain assessment of the sexual partner.

Requiring the Maryland Technology Development Corporation to establish a grant and loan program to provide grants and loans for Long COVID innovation; requiring the Corporation to contract with an independent review committee composed of scientific experts in the field of Long COVID; establishing the Maryland Long COVID Research Fund to promote State-funded life sciences research, development, commercialization, and manufacturing related to Long COVID; authorizing the Governor to include an appropriation to the Fund in the annual budget bill; etc.

Prohibiting the Maryland Department of Health and certain carriers from imposing a copay, coinsurance, or deductible for services provided in accordance with the Collaborative Care Model statewide in primary care settings that provide health care services to Program recipients.

Prohibiting an institution of higher education from denying access or services to a student based on the student's diagnosis of sickle cell disease; requiring an institution of higher education to provide reasonable accommodations for students with sickle cell disease; requiring the Maryland Department of Health to develop an education and awareness campaign for institutions of higher education in the State regarding students with sickle cell disease; etc.

Requiring the Governor to include in the annual budget bill at least 3% of the special funds collected from the Medicaid quality assessment imposed on certain nursing facilities to fund the operations of the Office of the Long-Term Care Ombudsman.

Prohibiting the Maryland Medical Assistance Program from applying a prior authorization requirement in certain circumstances to and from applying a step therapy or fail-first protocol for a prescription drug used to treat an adult enrollee's diagnosis of bipolar disorder, schizophrenia, major depression, post-traumatic stress disorder, or a medication-induced movement disorder associated with the treatment of serious mental illness.

Requiring the Maryland Department of Health to develop and implement a standard system to collect and compile annual data on the costs of prenatal care, birth, postpartum care, pregnancy care, abortion services, and menopausal care in the State; establishing limitations on the data and information that may be collected or reported under the Act; and requiring the Department to submit a comprehensive report of the collected data to the General Assembly on or before December 1 of each year.

Authorizing, beginning January 1, 2027, the Maryland Medical Assistance Program to provide comprehensive coverage for the treatment of obesity; and requiring the Maryland Department of Health to provide notice to Program recipients if the Department elects to provide the comprehensive coverage.

Requiring the Maryland Department of Health, as part of the newborn screening system, to screen for Gaucher disease.

Altering the purposes for which the Secretary of Health may make grants from or agreements for the use of State and federal funds with respect to the provision of services for problem gamblers; and altering the purposes for which the Maryland Department of Health may utilize the Problem Gambling Fund to provide reimbursement to support peers providing behavioral health services to individuals with problem gambling issues who are receiving treatment or participating in certain prevention programs.

Prohibiting the Maryland Department of Health and certain carriers from imposing a copay, coinsurance, or deductible for services provided in accordance with the Collaborative Care Model statewide in primary care settings that provide health care services to Program recipients.

Establishing the Workgroup on Behavioral Health Rate Methodology Modernization in the Maryland Health Care Commission to develop transparent, cost-based reimbursement methodologies for certified community behavioral health clinics and outpatient mental health centers; and requiring the Workgroup to report its findings and recommendations to the Governor and the General Assembly on or before October 1, 2027.

Authorizing, beginning January 1, 2027, the Maryland Medical Assistance Program to provide comprehensive coverage for the treatment of obesity; and requiring the Maryland Department of Health to provide notice to Program recipients if the Department elects to provide the comprehensive coverage.

Repealing a requirement that authorized prescribers submit prescriber-pharmacist agreements to the health occupations board that regulates the authorized prescriber; authorizing pharmacists, under certain circumstances, to enter into prescriber-pharmacist agreements that authorize the pharmacist to treat an opioid use disorder using controlled dangerous substances drug therapy; etc.

Requiring a certain physical examination used to determine the physical fitness of a student seeking to participate in interscholastic sports to include a certain cardiovascular prescreening; requiring certain health care providers who perform certain physical examinations for students participating in interscholastic sports to include a cardiovascular prescreening as part of the examination; etc.

Requiring the Governor annually to proclaim the month of May to be Brain Health and Chronic Headache Awareness Month; requiring the proclamation to align with a certain national brain tumor awareness initiative; establishing the Maryland Brain Health Grant Fund as a special, nonlapsing fund; requiring the Maryland Department of Health, in collaboration with certain entities, to develop guidelines on brain health screening; and requiring the Governor to include in the annual budget bill for fiscal 2028 an appropriation of $500,000 for the Fund.

Specifying that a petition for emergency evaluation is effective for 5 days after being endorsed by a certain court; authorizing a court, on a certain motion and for good cause shown, to extend a petition for up to 5 days at a time, not to exceed a total of 30 days; requiring the court to include the date the petition expires on the petition; and requiring peace officers to comply with a certain provision of law when executing a petition.

Requiring the Maryland Medical Assistance Program and certain insurers, nonprofit health service plans, health maintenance organizations, and managed care organizations to provide coverage for services provided in any setting by certain certified peer recovery specialists; and requiring the Maryland Department of Health to convene a certain workgroup on the certification process of peer recovery specialists.

Repealing the requirement that the Governor include in the annual budget bill a $350,000 appropriation to the State's Consumer Health Information Hub; requiring the Hub to carry out certain duties to the extent funding is available; and repealing the termination date for certain provisions of law related to consumer health information and the State's Consumer Health Information Hub.

Establishing the Ibogaine Clinical Research Grant Program to provide grants to certain research institutions to conduct certain clinical drug development trials on the use of ibogaine; and including the Program as an authorized use of funding from the Opioid Restitution Fund.

Repealing the prohibition against a surrogate authorizing treatment for a mental disorder for a person who has been certified to be incapable of making an informed decision.

Requiring certain facilities to inform individuals of certain rights relating to the participation of a family member or other authorized individual in the individual's plan of treatment; requiring facilities to recognize certain documents as an individual's formal request to allow a certain individual to participate in a certain plan; limiting the reasons for which a treating provider is authorized to withhold information on an individual's plan of treatment from certain third parties; etc.

Establishing requirements and prohibitions regarding food and milk product labeling; and requiring the Maryland Department of Health to create a marketing program and educational materials to inform consumers about the meaning of quality dates and safety dates for food labels by July 1, 2027, and to post the information on the Department's website.

Altering the definition of "baby food" for purposes of certain provisions of law governing baby food testing to include, rather than exclude, infant formula and to include infant cereal; and altering the defined term "toxic heavy metal" to be "toxic element" for purposes of certain provisions of law governing baby food testing.

Applying certain provisions of law governing the confidentiality of medical records to crisis pregnancy clinics.

Repealing a requirement that authorized prescribers submit prescriber-pharmacist agreements to the health occupations board that regulates the authorized prescriber; authorizing pharmacists, under certain circumstances, to enter into prescriber-pharmacist agreements that authorize the pharmacist to treat an opioid use disorder using controlled dangerous substances drug therapy; etc.

Establishing requirements and prohibitions governing the provision of community violence prevention services through telehealth under the Maryland Medical Assistance Program; requiring the Program to reimburse community violence prevention services that are provided in person regardless of the location at which the services were provided; prohibiting certain entities that employ or contract with a certified violence prevention professional from being required to maintain an affiliation with a hospital or trauma center; etc.

Altering the duties of the Virginia I. Jones Alzheimer's Disease and Related Dementias Council; establishing the Dementia Services and Brain Health Program in the Maryland Department of Health to lead the State's public health efforts relating to brain health and dementia; requiring the Director of Dementia Services and Brain Health to administer the Program; requiring the Program, rather than the Director, to perform certain duties and staff the Council; etc.

Requiring the Deputy Secretary for Developmental Disabilities to provide notice to the public before making changes to the Self-Directed Services Manual; requiring the Deputy Secretary to receive and consider comments on the proposed changes from the public for at least 90 days after the date on which the notice is provided; and prohibiting the Deputy Secretary from adopting the proposed changes until the public comment period has ended.

Requiring counties in which a volunteer fire company is located to offer no-cost preventive cancer screenings in accordance with certain guidelines to volunteer firefighters volunteering with the volunteer fire company; authorizing a county to satisfy the requirement by providing a certain annual examination or applying for a certain grant; requiring the volunteer fire companies to maintain and provide to the counties in which the companies are located a certain list of volunteer firefighters; etc.

Altering, from 5 days to 12 days, the period of time within which a certificate of birth is to be completed and filed with the Maryland Department of Health following a birth.

Establishing the Workgroup to Study Youth Camp and RV Park Emergency Preparedness; requiring the Workgroup to study model local emergency preparedness policies in the State for youth camps and RV parks; and requiring the Workgroup to make recommendations regarding potential legislation to address statewide emergency preparedness polices for youth camps and RV parks and report to the General Assembly by December 31, 2027.

Requiring the Behavioral Health Administration to adopt regulations authorizing a behavioral health program to relocate to another site; and requiring the regulations to address an expedited approval process, the use of documentation previously submitted, providing authorization for temporary approvals for a relocation, and authorization to consider the program's regulatory record as a basis for expediting the process.
